U.S. Senate panel still negotiating with Flynn over documents -congressional aides

Senate Intelligence Committee Chairman Richard Burr told news media late Thursday morning that Flynn's attorneys told him the former adviser won't obey a subpoena to cooperate as part of the panel's Russian Federation probe.

Sen. Richard Burr (R-N.C.) spoke with reporters about the denial to hand over the documents on Thursday, according to the Associated Press. "Consistent with the Committee's position since the beginning of or investigation, I welcome their willingness to cooperate". Mark Warner (D-Va.), the committee's vice chairman, said he believes Burr's comments that Flynn has more time to comply with the subpoena were correct.

The North Carolina senator later clarified his statement, leaving the question of whether Flynn would comply with the subpoena up in the air.

In April, the committee sent a series of requests to several former President Trump associates asking for records on any dealings with Russian Federation - a request Flynn's lawyers declined to cooperate with through counsel, sparking the subpoena.

Trump's beleaguered White House was hit with yet another explosive allegation on Wednesday, after a New York Times report alleged that the US President's transition team knew that Flynn.was under federal investigation for secretly working as a paid lobbyist for Turkey weeks before the President's inauguration.

Despite the disclosure, Trump appointed Flynn as his national security adviser.

On May 18, sources familiar with the FBI investigation into Russia's role in the election disclosed that Flynn had six previously undisclosed instances of communication with Russian officials between April through November 2016. Flynn reportedly had six undisclosed phone calls with Russian Ambassador to the U.S. Sergei Kislyak. President Trump brought him on anyway.

The committee said it sent a letter requesting material from the FBI and Justice Department related to its ongoing counterintelligence investigation. Robert Kelner, Flynn's attorney, stated that the former national security adviser would not "submit to questioning in such a highly politicized, witch-hunt environment without assurances against unfair prosecution".

Congressional aides told Reuters the committee was still negotiating in the hopes of obtaining the requested documents.

Flynn "is not cooperating so far". The process took years, however, and the judge ultimately declined to hold Holder in civil contempt - which would have resulted in fines being assessed against Holder.

"If I were his lawyer, I'd probably be making the argument that if I'm under criminal investigation, you can not force me to compromise myself", Graham said.
