SC suggests govt bring law to address triple talaq issue

Picking up an Islamic religious text during the high-voltage hearing and reading it, Chief Justice J S Khehar heading five judge bench hearing a batch of petitions challenging the constitutional validity of triple talaq said, 'somebody gave this book to us.it says Talaq-e-biddat is a deviation from the right path.

Apparently stating the contention that triple talaq is not sanctioned by the Koran, Sibal said, "you can not go to the Koran and decide what Islam is".

Contesting AIMPLB's claim to be a representative voice of the Muslim community, senior counsel Anand Grover said that Talaq-i-bidat was not an essential part of the Sunni Muslim faith, thus it has been changed in several Sunni-majority countries. The board also clarified that its suggestions are advisory in nature and it can not guarantee of its effects.

Justice Joseph told Mr Sibal, "Triple talaq is sinful". Probably, he was well aware of the origin, practice and prevalence of triple talaq among Muslims in India and overseas.

As he referred to the Vishakha guidelines that were framed by the top court to protect women at workplace in the absence of any law, Justice Kurian Joseph said that it was in the domain of a statute and not the Constitution. The bench had made it clear that it would examine whether the practice of triple talaq among Muslims is fundamental to their religion and had also said for the time being it will not deliberate upon the issue of polygamy and "nikah halala".

Also arguing for the Jamiat Ulema-e-Hind, senior advocate Raju Ramachandran said the judiciary can not take on the mantle and wisdom of religious schools and dictate to a religious community what personal law practices and norms to follow.

In a last-ditch effort to stave off a drastic overhaul by the courts, the AIMPLB has indicated that it is willing to ask the qazis to provide Muslim women the option of keeping out the much-abused triple talaq practice out of their marriage contracts, and ask for a large amount of alimony.

Mr. Giri insisted that triple talaq is a part of religion and "if it is part of religion, it is protected by Article 25 [freedom of religion] of the Constitution".
