The family's attorney says the video is proof that Gabe was bullied at Carson Elementary School just two days before his death.

The 750-student school failed to disclose to Gabriel's mother the events that occurred that day, preventing her from her parental duty of adequately adhering to her child's state. Doctors concluded he likely had a stomach virus and sent him home.

As ABC News reports, immediately after he walks into the bathroom, Gabriel appears to shake hands with a fellow student before falling to the ground and remaining there, unmoving, for nearly eight minutes.

No charges have been filed, officials said.

Cincinnati Public Schools is reviewing with faculty and staff the procedures regarding adult supervision in the restrooms, and is committed to student safety, the district's statement said. "Him going to the nurse's station or him not wanting to go to school, that was his way of trying to communicate with me".

On Friday, the Cincinnati Public Schools released the video recorded January 24 outside a school bathroom.

"It is my obligation to make sure that this will never happen again", she said.

Gabriel's mother took him to the hospital later that evening after he vomited and complained of stomach pains.
